Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

CRM Platform refers to any supported customer relationship management platform that You authorize Remi to access and operate on Your behalf.


Cookies are small files placed on Your computer, mobile device, or any other device by a website, containing details of Your browsing history on that website among its many uses.


Country refers to: United States


Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

Personal Data is any information that relates to an identified or identifiable individual.

Service refers to the Remi AI voice assistant, the Application, and the Website, or any combination thereof.

Service Provider means any natural or legal person who processes data on behalf of the Company to facilitate or deliver the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.

Website refers to Remi, accessible from https://callremi.ai

You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information. This may include, but is not limited to:

* CRM Platform API credentials provided by You to enable authorized CRM access

CRM Data Accessed on Your Behalf

When You authorize Remi to access Your CRM Platform, Remi reads and writes data within that platform solely at Your direction and on Your behalf. This may include contact records, notes, tasks, appointments, conversation history, and calendar data.

This data belongs to You and Your contacts. We access it only to execute the specific voice commands You provide through the Service. We do not use Your CRM data for any purpose other than fulfilling Your requested actions, and we do not share, sell, or transfer it to any third party for any independent purpose.

As a real estate professional connecting Your CRM Platform to the Service, You acknowledge that Your CRM data may contain personal information belonging to Your clients and prospective clients, including homebuyers, sellers, and other third parties who are not parties to these Terms. You represent and warrant that You have the authority to connect this data to third-party services, and that Your use of the Service complies with all privacy laws applicable to Your clients' personal information, including but not limited to the California Consumer Privacy Act where applicable. Thrive Now Media processes Your clients' data solely at Your direction and solely to execute the actions You request. Thrive Now Media does not accept liability for Your compliance obligations to Your own clients or end users.

Voice and Call Data

When You use the Remi voice service, Your calls are processed through third-party service providers that handle voice infrastructure, transcription, and AI language interpretation. These providers are engaged solely to deliver the Service and are contractually prohibited from using Your data for their own independent purposes.

Call transcription data may be retained for service quality and debugging purposes for a maximum of 30 days, after which it is deleted. You may request deletion of Your call data at any time by contacting Us.

Call Recording and Transcription Consent

All voice calls conducted through the Service are recorded and transcribed using automated systems for the purpose of executing Your CRM commands and maintaining service quality. By using the Service, You acknowledge and consent to this recording and transcription.

Outbound calls made to beta program applicants and prospective users include an automated disclosure at the start of each call stating that the call is automated and will be recorded. By continuing on the call after receiving this disclosure, the recipient consents to being recorded for the purposes described in this Policy.

California residents are advised that California Penal Code § 632 requires all parties to a confidential communication to consent to any recording of that communication. By using this Service, You provide that consent. If You access the Service from a jurisdiction with applicable recording consent laws, You are responsible for ensuring Your compliance with those laws.

Usage Data

Usage Data is collected automatically when using the Service and may include information such as Your device's IP address, browser type, browser version, pages visited, time and date of visit, and other diagnostic data.

SMS Communications and A2P Messaging Compliance

Consent to Receive SMS Messages

By providing Your mobile phone number and opting in through Our Service, You consent to receive SMS text messages from Thrive Now Media, LLC related to Your Remi account, including service notifications, onboarding information, and account updates.

Consent is not a condition of purchase. You are not required to consent to receive SMS messages in order to purchase or use the Service.

Message Frequency

Message frequency will vary based on account activity and service updates. You will not receive more messages than are necessary for the operation and support of Your account.

How to Opt Out

You may opt out of SMS messages at any time by replying STOP to any message You receive from Us. After opting out, You will receive one final confirmation message and no further SMS messages will be sent.

Message and Data Rates

Standard message and data rates may apply depending on Your mobile carrier and plan.

No Third-Party Sharing of Mobile Numbers

We utilize the mobile numbers You provide solely for direct service communications from Thrive Now Media, LLC.

WE DO NOT SELL, rent, lease, or otherwise share Your mobile phone number with any third party for any purpose.

No mobile information will be shared with third parties or affiliates for marketing, promotional, or any other purposes. Your mobile number will not be used for lead generation, remarketing, or shared with any advertising platform. Text messaging

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

To provide and maintain our Service, including monitoring usage and ensuring voice commands are executed accurately within Your CRM Platform.

To manage Your Account, including Your registration and access to the Service.

For the performance of a contract, including fulfilling the terms of Your subscription to the Service.

To contact You regarding service updates, account notifications, security notices, or support communications.

To manage Your requests, including support inquiries and feedback.

For business transfers, We may use Your information to evaluate or conduct a merger, divestiture, restructuring, or other transfer of some or all of Our assets.

For service improvement, such as analyzing usage patterns and improving the accuracy and reliability of the Service.

How We Share Your Personal Data

With CRM Platform Providers

We transmit data to and from Your authorized CRM Platform solely to execute the actions You request through the Service. This transmission occurs only at Your direction.

With Third-Party Service Providers

To deliver the Service, We engage third-party providers who handle specific technical functions including voice infrastructure, transcription, and AI language processing. These providers access only the data necessary to perform their function and are prohibited from using Your data for any independent purpose.

With Web Service Providers

We may share Your personal information with web service providers to monitor and analyze the use of Our Service.

For Business Transfers

We may share or transfer Your personal information in connection with any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

For Legal Requirements

We may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities, or in the good faith belief that such action is necessary to comply with a legal obligation, protect the rights or property of the Company, or protect the personal safety of users of the Service or the public.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy.

Call transcription and voice session data is retained for a maximum of 30 days and then permanently deleted, unless We are legally obligated to retain it for a longer period or You have requested earlier deletion.

CRM access credentials are retained only while Your account is active. Upon cancellation, credentials are revoked and deleted within 7 business days.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in processing are located.

Your consent to this Privacy Policy followed by Your submission of such information represents

Your agreement to that transfer. The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. You may contact Us at any time to request access to, correction of, or deletion of any personal information You have provided, including call transcripts and CRM credentials stored by the Service.

Please note that We may need to retain certain information when We have a legal obligation or lawful basis to do so.

Security of Your Personal Data

The security of Your Personal Data is important to Us. Your CRM API credentials are stored encrypted and are never disclosed via voice or transmitted to any party other than the CRM Platform they are authorized to access.

You are responsible for maintaining the confidentiality of Your API credentials. If You believe Your credentials have been compromised, revoke and reissue them in Your CRM Platform immediately and notify Us at [email protected].

No method of transmission over the Internet or method of electronic storage is 100% secure, and We cannot guarantee absolute security.

Data Breach Notification

In the event of a security breach resulting in unauthorized access to or acquisition of personal information that is reasonably likely to cause harm to affected individuals, We will notify You in accordance with applicable law.

For California residents, notification will be provided in accordance with California Civil Code § 1798.82 without unreasonable delay and in no case later than 72 hours after We discover a breach affecting California residents.

Notification will be delivered by email to the address associated with Your account and by posting a notice on callremi.ai. The notification will include, to the extent known at the time: the nature of the breach, the categories of personal information affected, the approximate date of the incident, steps You can take to protect

Yourself, and the remediation steps We are taking.

If the breach involves Your CRM Platform credentials, We will notify You immediately and advise You to revoke and reissue Your API credentials within Your CRM Platform without delay.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us immediately.

Links to Other Websites

Our Service may contain links to other websites not operated by Us. We strongly advise You to review the Privacy Policy of every site You visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

California Privacy Rights
