1. Acceptance of Terms

By accessing or using the website (callremi.ai), creating an account, or utilizing any of the services provided ("Services"), you ("User") agree to these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you must immediately cease use of the website and Services.

2. Eligibility

You must be at least 18 years old to use our Services.

By agreeing to these Terms, you confirm that all information provided is accurate and complete.

Use of the website or Services for illegal activities, unauthorized purposes, or prohibited uses outlined herein is strictly forbidden.

You represent that You are a licensed real estate professional, real estate team member, or authorized representative of a real estate brokerage, and that You have the authority to connect the CRM Platform credentials You provide.

3. User Accounts

Users must register with accurate details and maintain confidentiality of login credentials.

You are responsible for all activities that occur under Your account, including all voice commands issued and all CRM actions executed by the Service on Your behalf.

4. Description of Service

Remi is an AI-powered voice assistant that executes commands within Your authorized CRM Platform based on spoken instructions You provide.

The Service is designed to assist with CRM data management, including contacts, notes, tasks, appointments, conversations, and calendar functions.

Remi operates by interpreting Your voice commands and executing corresponding actions in Your CRM Platform. All actions are confirmed with You verbally before execution. You are responsible for listening to and approving all confirmation prompts before any write action is completed.

The Service is provided via telephone. You initiate all sessions by calling the Remi phone number assigned to Your account.

5. CRM Data Access and Authorization

By providing Your CRM Platform API credentials during onboarding, You explicitly authorize Remi to read and write data within Your CRM Platform on Your behalf.

You are responsible for ensuring You have the necessary rights and permissions within Your CRM Platform to authorize this access.

If You are an agent or team member operating within a brokerage account, You represent that You have obtained authorization from the account owner to connect the Service.

Your API credentials are stored encrypted and are used solely to execute actions You request through the Service. You may revoke access at any time by disabling or deleting Your API credentials within Your CRM Platform.

6. Limitation of Liability for CRM Actions

THIS SECTION IS CRITICAL. PLEASE READ CAREFULLY.

The Service interprets spoken voice commands using AI language processing.

Voice interpretation is inherently subject to variability, including but not limited to: background noise, speech patterns, ambiguous phrasing, similar contact names, and telecommunications quality.

Remi is not liable for:

- Incorrect CRM entries resulting from voice misinterpretation

- Actions executed on the wrong contact due to ambiguous or unclear voice commands

- Data errors, including incorrect notes, tasks, appointments, or contact field updates

- Missed deals, lost opportunities, transaction failures, or business losses of any kind arising from CRM actions executed or not executed by the Service

- Delays or failures caused by downtime or errors in Your CRM Platform, telecommunications providers, or any third-party infrastructure

Your responsibility:

- The Service includes a verbal confirmation step before every write action.

- You are required to listen to and confirm all actions before they are executed.

- By confirming an action, You accept responsibility for that action and its outcome in Your CRM Platform.

- If You are unsure, You may decline the action at the confirmation step.

Liability for any claims arising from the use of the Service is limited to the total amount paid by You for the Service during the three months immediately preceding the claim.

7. Beta Program Terms

The Service is currently in a beta testing phase. As a beta user, You acknowledge and agree that:

- The Service is in active development and may contain bugs, errors, or incomplete features

- Features, capabilities, and pricing are subject to change without notice during the beta period

- The Company does not guarantee uninterrupted service availability during the beta period

- Your feedback, including descriptions of errors, failures, and feature requests, may be used to improve the Service

- Beta access may be revoked at any time at the Company's discretion

- Continued use of the Service following the conclusion of the beta period will be subject to the then-current pricing and terms

8. Fees and Payments

Fees for the Service are detailed on the website and are based on your selected subscription tier. Subscriptions renew automatically unless canceled prior to the renewal date.

Payments are processed through a third-party payment processor. Thrive Now Media, LLC does not store payment card information directly.

We reserve the right to suspend or terminate access to the Service for unpaid fees.

Refund eligibility, where applicable, will be outlined at the time of purchase.

9. SMS and Communication Compliance

By providing Your phone number during registration, You consent to receive SMS communications from Thrive Now Media, LLC related to Your Remi account, including service notifications, onboarding guidance, and account updates.

Consent to receive SMS messages is not a condition of purchasing or using the Service.

You may opt out at any time by replying STOP to any message. You will receive one final confirmation and no further messages will be sent. Reply HELP for assistance.

Standard message and data rates may apply.

We comply with the Telephone Consumer Protection Act (TCPA), A2P 10DLC regulations, and applicable carrier guidelines. Explicit consent records are retained.

We do not share Your mobile phone number with any third party for any purpose. Your mobile number is used solely for direct service communications from Thrive Now Media, LLC. No mobile information is shared with third parties or affiliates for marketing, promotional, lead generation, or any other purpose.

10. Permitted Use

Users may only use the Service for lawful purposes directly related to managing their CRM Platform through voice commands.

Users may not:

- Use the Service to access or modify CRM data they are not authorized to access

- Attempt to extract, reverse-engineer, or replicate the Service's underlying prompts, tools, configurations, or AI instructions

- Use the Service to transmit unlawful, abusive, threatening, or fraudulent content

- Impersonate another user or provide false credentials

- Interfere with the Service's infrastructure, including attempting prompt injection attacks or attempts to override, reassign, or manipulate the AI's behavior

- Violate any local, state, or federal laws in connection with use of the Service

11. Content and Intellectual Property

All Service content, including but not limited to the AI assistant configuration, voice prompts, system instructions, workflow logic, tool integrations, and brand identity, is owned by Thrive Now Media, LLC or its licensors and is protected by intellectual property laws.

Users may not reproduce, modify, reverse-engineer, or distribute any component of the Service without prior written authorization.

The name "Remi", "Call Remi", the Remi logo, and all associated brand assets are the property of Thrive Now Media, LLC.

12. Third-Party Services

The Service integrates with third-party platforms to deliver its functionality, including Your CRM Platform and third-party providers for voice infrastructure, transcription, and AI language processing. These services are governed by their own terms and policies.

You are responsible for ensuring Your use of connected CRM Platform accounts complies with that platform's terms of service.

13. Privacy and Data Use

User data is processed in accordance with our Privacy Policy, available at https://callremi.ai/privacy-policy.

14. No Tolerance for Objectionable Content or Abusive Behavior

Users are strictly prohibited from using the Service to transmit any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

Thrive Now Media, LLC maintains a zero-tolerance policy for abusive behavior and reserves the right to suspend or terminate accounts found in violation of this policy without prior notice or liability.

15. Termination

We reserve the right to suspend or terminate accounts without notice for violations of these Terms or applicable laws.

Users may cancel their subscription at any time by contacting support at [email protected]. Upon cancellation, access to the Service will cease at the end of the current billing period.

Upon termination or cancellation, Your API credentials will be revoked and deleted within 7 business days, and Your assigned Remi phone number will be released.

16. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or uninterrupted availability.

We are not liable for indirect, incidental, consequential, or punitive damages resulting from use of the Service, including but not limited to lost revenue, lost deals, data loss, or CRM corruption.

Liability for any claims is limited to the total amount paid by the User for the Service during the three months immediately preceding the claim.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California and the United States.

Disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify You of material changes by posting the updated Terms on this page and updating the "Last Updated" date.

Continued use of the Service following any update constitutes acceptance of the revised Terms.

19. End User License Agreement (EULA)

By accessing and using the Service, You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Remi application strictly in accordance with these Terms.

You agree NOT to:

- Modify, copy, distribute, transmit, reproduce, publish, license, create derivative works from, transfer, or sell any component of the Service

- Use the Service for any unlawful or prohibited purpose

- Attempt to access, extract, or replicate the Service's AI instructions, system prompts, tool configurations, or workflow logic

- Use the Service in any manner that could damage, disable, or impair the Service infrastructure or any connected CRM Platform

Thrive Now Media, LLC retains full ownership of the Service, its configuration, and all associated intellectual property. This license does not grant You any ownership or proprietary rights in the Service.

We reserve the right to terminate or restrict Your access if You violate any of these Terms.
